Arbitration Agreement and Class Action Waiver
Dispute-resolution terms for Platform users, Customers, Drivers, subscribers, visitors, and account holders.
Agreement to Arbitrate
To the maximum extent permitted by law, you and The Delivery Truck, Inc. agree that any dispute, claim, controversy, or demand arising out of or relating to the Platform, these legal terms, your account, a job, payments, subscriptions, communications, safety incidents, referrals, marketing, or your relationship with The Delivery Truck, Inc. will be resolved by binding individual arbitration rather than in court.
Claims Between Customers and Drivers
Customer-driver disputes are primarily between the Customer and Driver. If The Delivery Truck, Inc. is named in a dispute, this Arbitration Agreement applies to claims against The Delivery Truck, Inc. to the maximum extent permitted by law. Nothing prevents a Customer and Driver from resolving their direct dispute independently.
Class Action and Jury Trial Waiver
You and The Delivery Truck, Inc. waive the right to a jury trial and waive the right to participate in class, collective, consolidated, representative, mass, private attorney general, or multi-party proceedings, except where a nonwaivable law prohibits waiver.
Arbitration Provider and Location
Unless the parties agree otherwise, arbitration will be administered by the American Arbitration Association under applicable consumer or commercial arbitration rules. Arbitration may occur remotely, by documents, or in Florida, unless applicable law requires another location.
Small Claims and Government Agencies
Either party may bring an individual claim in small claims court if it qualifies. Nothing prevents either party from reporting concerns to a government agency, cooperating with an agency investigation, or asserting nonwaivable statutory rights.
Opt-Out
You may opt out of this Arbitration Agreement within 30 days after first accepting the Terms by emailing legal@thedeliverytruck.com with your full name, account email, mailing address, and a clear statement that you opt out of arbitration. Opting out does not affect other Platform terms.
Severability
If a court finds any portion of this Arbitration Agreement unenforceable, the unenforceable portion will be severed to the minimum extent necessary. If the class waiver is unenforceable for a claim, that claim may proceed in court while remaining arbitrable claims proceed individually.
