Data Processing Addendum
Data-processing terms for business customers, vendors, and partners where a written addendum is needed.
Purpose
This Data Processing Addendum applies only where The Delivery Truck, Inc. and another party enter into a written agreement that expressly incorporates it. It does not replace the Privacy Policy for ordinary consumers or Drivers.
Roles
Depending on the context, The Delivery Truck, Inc. may act as an independent controller/business, processor/service provider, or joint participant in processing. For standard marketplace users, The Delivery Truck, Inc. generally determines Platform purposes and means for account, safety, fraud, payment, support, and marketplace operations.
Processing Instructions
Where The Delivery Truck, Inc. acts as a processor/service provider for a business customer, it will process covered personal data according to documented instructions, applicable law, and the agreement, including for security, support, compliance, and service improvement where permitted.
Confidentiality and Security
The Delivery Truck, Inc. will use reasonable safeguards and restrict access to personnel or vendors with a need to process data. No safeguard can guarantee absolute security.
Subprocessors
The Delivery Truck, Inc. may use hosting, payment, analytics, communications, support, mapping, background-check, security, and infrastructure vendors. A current vendor list should be maintained in the admin Vendor page when production vendors are configured.
Deletion and Return
Upon lawful request and subject to retention needs, The Delivery Truck, Inc. will delete, return, or deidentify covered personal data where feasible. Retention may be required for tax, payment, fraud, safety, dispute, insurance, legal, or audit purposes.
Conflicts
If this Addendum conflicts with nonwaivable privacy law, the law controls. If it conflicts with the main agreement, the more privacy-protective term controls for covered personal data.
