Master terms governing access to and use of The Delivery Truck marketplace Platform.
Acceptance of Terms
By accessing, browsing, creating an account, requesting a job, applying as a Driver, using admin tools, paying for a job, subscribing to PRO, sending messages, uploading content, or otherwise using the Platform, you agree to these Terms of Service and all policies linked in the Legal & Policy Center.
If you use the Platform on behalf of a company, household, trust, property owner, retailer, moving company, or other organization, you represent that you have authority to bind that party.
Marketplace Role
The Delivery Truck, Inc. operates The Delivery Truck website, web app, mobile applications, administrative tools, payment interfaces, communications tools, referral tools, and related technology features (collectively, the "Platform"). The Platform is designed to help customers identify and communicate with independent third-party drivers, delivery providers, moving providers, helpers, or other service providers who may choose to offer delivery-related services ("Drivers" or "Service Providers").
The Delivery Truck, Inc. is not a motor carrier, common carrier, household goods mover, freight forwarder, broker, moving company, delivery company, employer of Drivers, insurer, guarantor, or bailee of property, except to the extent a nonwaivable law expressly imposes a different status. The Platform provides technology, listing, communications, payment facilitation, support, dispute intake, and recordkeeping tools only.
When a Customer requests or books a job, the delivery, hauling, loading, unloading, placement, packing, assembly, disassembly, route selection, equipment selection, labor, handling, and completion of that job are provided by the selected Driver or Service Provider, not by The Delivery Truck, Inc. The Customer and Driver form a direct service contract with each other.
Customer-Driver Contract
Each job is a direct contract between the Customer and the selected Driver. The Customer is the hiring party. The Driver is the service provider. The Delivery Truck, Inc. is not a party to the delivery services contract, except for Platform terms, payment-facilitation rights, support processes, dispute intake, and marketplace rules.
The Customer and Driver are responsible for agreeing on job details, pickup and drop-off conditions, placement, stairs, elevators, loading assistance, item condition, access, timing, communication, proof photos, and any lawful special instructions.
Customer Due Diligence
Customers are solely responsible for deciding whether to hire, select, approve, or continue working with any Driver. Before hiring or allowing a Driver to handle property, enter property, operate on premises, or transport an item, Customers should independently verify the Driver's identity, vehicle suitability, license status, insurance, permits, equipment, qualifications, experience, references, and legal authority to perform the requested work.
Any badges, profiles, document uploads, application status labels, star ratings, reviews, background-check references, insurance references, or marketplace status shown on the Platform are informational tools only. They are not warranties, endorsements, guarantees, or replacements for the Customer's own due diligence.
The Delivery Truck, Inc. does not guarantee that a Driver is licensed, insured, bonded, qualified, available, safe, suitable, lawful, or able to complete any particular job. Customers hire Drivers at their own risk and may decline, cancel, or stop work if they are not comfortable with a Driver or the Driver's documentation.
Driver Independence
Drivers are independent businesses or individuals who choose whether to use the Platform. Drivers are not employees, agents, franchisees, joint venturers, partners, representatives, or legal delegates of The Delivery Truck, Inc. No Driver may represent that they are employed by The Delivery Truck, Inc. or authorized to bind The Delivery Truck, Inc.
Drivers decide whether to accept or decline job opportunities, what vehicle and lawful equipment to use, whether to use helpers or subcontractors where permitted, how to perform the work, what lawful route to take, how to secure items, and whether the job is within their capability, subject to applicable law, Customer instructions, safety rules, and marketplace eligibility standards.
Drivers are solely responsible for taxes, licenses, permits, vehicle ownership or leasing, maintenance, fuel, tolls, parking, citations, insurance, workers' compensation if required, helpers, tools, equipment, safety practices, business expenses, and legal compliance.
Accounts and Eligibility
You must provide accurate information, keep credentials secure, promptly update account details, and comply with law. We may refuse, suspend, limit, or terminate accounts for safety, fraud, legal, payment, compliance, reputation, or operational reasons.
You may not create fake accounts, impersonate another person, evade suspensions, manipulate reviews, bypass Platform payment, or use the Platform for prohibited items or unlawful jobs.
Payments, Fees, and Limited Payment Collection Agency
Payments may be processed by Stripe or another third-party payment processor. When the Platform collects amounts designated for a Driver, The Delivery Truck, Inc. acts only as a limited payment collection agent for the Driver for that purpose. Receipt of payment by The Delivery Truck, Inc. or its processor may satisfy the Customer's payment obligation to the Driver only to the extent funds are successfully received and not reversed, disputed, refunded, charged back, held, or otherwise invalidated.
Platform fees, subscription fees, cancellation fees, dispute fees, payment-processing fees, taxes, tips, driver payouts, promotional credits, and refunds may be calculated or handled separately. Displayed estimates are not guaranteed unless expressly confirmed in writing.
No Custody or Bailment
The Delivery Truck, Inc. does not take possession, custody, or control of Customer property and does not become a bailee, warehouse, mover, carrier, packer, or insurer of items. Any custody or handling of property occurs between the Customer and Driver.
Disputes, Records, and Communications
Job-related messages, photos, timestamps, GPS signals, status changes, payment events, account actions, support tickets, and admin notes may be stored for safety, quality, fraud prevention, tax, insurance, dispute, and legal purposes. Customer-driver chat during an active job may be saved with the job record.
Disputes between Customers and Drivers should be reported promptly. The Delivery Truck, Inc. may provide support tools or review information, but does not guarantee mediation, payment recovery, insurance coverage, or resolution.
Disclaimers and Liability Limits
To the maximum extent permitted by law, The Delivery Truck, Inc. disclaims liability for acts or omissions of Customers, Drivers, helpers, subcontractors, retailers, sellers, property owners, building managers, payment processors, mapping providers, communications providers, app stores, or other third parties.
Property damage, cargo loss, theft, personal injury, traffic violations, parking violations, premises damage, item suitability, loading decisions, route decisions, missed delivery windows, customer-driver disputes, and insurance claims are matters between the Customer and Driver unless a nonwaivable law states otherwise.
To the maximum extent permitted by law, The Delivery Truck, Inc.'s total liability for any claim relating to the Platform or a job will not exceed the greater of the Platform fees paid to The Delivery Truck, Inc. for the specific job giving rise to the claim or one hundred dollars ($100), excluding amounts collected on behalf of a Driver, taxes, tips, third-party charges, or amounts prohibited from limitation by law.
Indemnity
You agree to defend, indemnify, and hold harmless The Delivery Truck, Inc., its owners, officers, directors, employees, contractors, affiliates, vendors, licensors, and payment processors from claims, losses, liabilities, damages, penalties, costs, and attorneys' fees arising from your use of the Platform, your job, your property, your services, your content, your violation of law, your breach of these terms, your dispute with another user, or your acts or omissions.
Arbitration and Class Action Waiver
The Arbitration Agreement applies to the maximum extent permitted by law. It requires most disputes to be resolved by binding individual arbitration and not by class action, jury trial, or representative proceeding, unless you validly opt out or a nonwaivable law prohibits arbitration.
Changes
We may update these terms by posting revised terms with a new date. Continued use after the effective date means acceptance of the updated terms. Material changes may receive additional notice when legally required.
