Driver-specific terms for independent businesses and individuals using the marketplace to receive job opportunities.

Important: The Delivery Truck is a technology marketplace. Unless a separate written agreement says otherwise, The Delivery Truck, Inc. does not provide delivery, moving, transportation, carrier, freight, household-goods, warehousing, packing, or labor services. Customers and independent drivers/service providers contract directly with each other.

Independent Business Status

Drivers are independent businesses or individuals who choose whether to use the Platform. Drivers are not employees, agents, franchisees, joint venturers, partners, representatives, or legal delegates of The Delivery Truck, Inc. No Driver may represent that they are employed by The Delivery Truck, Inc. or authorized to bind The Delivery Truck, Inc.

Drivers decide whether to accept or decline job opportunities, what vehicle and lawful equipment to use, whether to use helpers or subcontractors where permitted, how to perform the work, what lawful route to take, how to secure items, and whether the job is within their capability, subject to applicable law, Customer instructions, safety rules, and marketplace eligibility standards.

Drivers are solely responsible for taxes, licenses, permits, vehicle ownership or leasing, maintenance, fuel, tolls, parking, citations, insurance, workers' compensation if required, helpers, tools, equipment, safety practices, business expenses, and legal compliance.

Not Hired by The Delivery Truck

Unless you sign a separate written agreement expressly hiring you for a specific corporate task, you are not contracted by The Delivery Truck, Inc. to perform deliveries. You use the Platform to find Customers who may hire you directly. The Delivery Truck, Inc. does not guarantee work, assignments, hours, revenue, territory, exclusivity, or continuation of access.

Required Authority and Insurance

You are solely responsible for maintaining any licenses, permits, registrations, vehicle insurance, commercial insurance, cargo insurance, general liability insurance, workers' compensation, helper coverage, local business registrations, moving authority, DOT authority, or other approvals required for the jobs you accept.

If a Customer asks for documents, provide accurate proof or decline the job. Do not misrepresent coverage, authority, experience, vehicle capacity, helper availability, or legal qualifications.

Job Acceptance and Performance

You must review each request and decline jobs you cannot safely, lawfully, or competently complete. You control the means and methods of performance, but you must comply with law, Customer instructions, safety standards, Platform rules, payment rules, and dispute recordkeeping requirements.

Helpers and Subcontractors

If you use helpers, employees, contractors, partners, or subcontractors, you are solely responsible for them, including background, insurance, taxes, wages, workers' compensation, safety, conduct, and legal compliance. The Platform may restrict or require disclosure of helpers for safety or compliance reasons.

Payments and Taxes

Driver payouts are processed through third-party payment providers and may be delayed, reversed, withheld, adjusted, or offset for chargebacks, refunds, cancellations, disputes, fraud, tax reporting, identity verification, or legal compliance. You are solely responsible for all taxes and business expenses.

No Employee Benefits

You are not entitled to minimum wage, overtime, unemployment insurance, workers' compensation, paid leave, expense reimbursement, retirement benefits, health benefits, employment benefits, or other employee protections from The Delivery Truck, Inc., except where nonwaivable law says otherwise.

Safety, Damage, and Claims

You are responsible for safe loading, securing, transport, unloading, placement, driving, and property protection for jobs you accept. You are responsible for damage, loss, citations, injuries, and claims caused by your acts or omissions, your vehicle, your equipment, or your helpers.

Marketplace Access

The Delivery Truck, Inc. may suspend, limit, deactivate, remove, or investigate Driver access for safety, fraud, poor performance, expired documents, insurance concerns, customer complaints, legal issues, payment issues, abusive conduct, or violation of marketplace rules. Deactivation does not create an employment termination.

Indemnity

You agree to defend, indemnify, and hold The Delivery Truck, Inc. harmless from claims arising from your services, vehicle, helpers, documentation, insurance, taxes, employment classification, misrepresentations, customer disputes, property damage, personal injury, or violation of law.
